“Kind Enough To Leave Her Alive”: A Madhya Pradesh court reduces the rapist’s sentence

The rape of a four-year-old child was referred to by the Madhya Pradesh High Court as "a demonic deed," but the rapist's life sentence was later lowered to 20 years because "he was gracious enough to leave [the kid] alive."
The prisoner had asked for the 15 years of his current sentence to be considered sufficient. This court does not find it to be a fit case where the sentence can be reduced to the sentence already served by the [convict], who appears to have no respect for the dignity of a woman and has a propensity to commit sexual offenses even with a girl child aged four years, the High Court's Indore bench ruled.

The pair of Justices Subodh Abhyankar and Satyendra Kumar Singh continued, "However, given the fact that he was compassionate enough to leave the [daughter] alive, this court is of the opinion that the life imprisonment can be reduced to 20 years rigorous imprisonment."

The High Court upheld the Additional Sessions Judge in Indore's judgment of conviction for no justifiable reason.

The guy brought the girl into his hut under the guise of giving her a rupee when he used to reside in a tent next to the house of the girl's family, all of whom worked as laborers.

The guy raped the girl in front of the girl's grandma. The girl was raped, as shown by her testimony and the medical data.
