What is interim bail?
Interim bail is a short term bail. The court gives it when the hearing on the application of regular bail is going on.
When a person files an application for regular bail, the court asks for the charge sheet or case diary in this case so that a decision on the general bail can be taken.
This entire process takes time. The person has to remain in custody while the documents reach the court. In such a situation, the person in custody can ask for interim bail. So that the person can get relief from being in custody till the time the documents reach the court.
This is available when the accused has applied for bail but the charge sheet has not been filed. Interim bail is always granted for a short period and is given by the court along with the conditions.
In this way, interim bail is a temporary bail of short duration. After receiving the documents, the court conducts further hearing on general bail. The provision of interim bail is so that due to delay in documents, no person has to remain in custody for a long time.
